Template Terms & Policies for Hey Dani Creative, LLC

I reserve the right, in my sole discretion, to change the Terms under which my products and services are offered. The most current version of the Terms will supersede all previous versions. I encourage You to periodically review the Terms to stay informed of any updates.

NOTICE:​ ​These​ ​Terms​ ​and​ ​Policies​ ​are​ ​legally​ ​binding.​ ​It​ ​is​ ​your responsibility​ ​to​ ​read​ ​these​ ​Terms​ ​carefully​ ​prior​ ​to​ ​purchase, use​ ​or​ ​access​ ​of​ ​any​ ​of​ ​my ​products or services. By viewing this website or anything made available on or through this website, you are agreeing to accept all parts of these Terms & Policies. Thus, if you do not agree to the Terms below, stop now and do not access or use this website.

Template policy

→ It will be your responsibility to add your existing content to your template once I have handed over the design. My templates are built design site templates and therefore cannot be applied/transferred to another site. You cannot then apply the template to another/existing Squarespace site.

→ Once the template has been transferred, it is no longer my responsibility, I am not required to reinstall the template if you change or delete any content/styles or change. Once your template has been transferred, the service is considered complete.

→ Template designs are sold as-is. Once the template has been installed, I am not required to reinstall the template if a newer version or design is released. I can’t guarantee lifetime updates to the content if the template has been retired/removed from the store, or it will no longer be updated.

→ You are responsible for preserving your chosen template’s demo pages, there is no one-click reinstallation of the template. If you purchase a setup package, I will provide duplicated, disabled demo pages in case you need them later, however, you are responsible for ensuring these remain preserved on your website.

→ I will always do my best to have your template installed within 48 business hours (Monday to Friday, 10:00 - 5:00 EST time), 48 hours does not include the day of purchase, weekends, or national holidays e.g. If you purchase on Monday, your template will be with you by the end of Wednesday. In the rare case that it will take longer, I will always let you know. Although rare, I cannot guarantee that transfer will always be within 48 hours.

→ You are responsible for upgrading your trial site with Squarespace within your 6-month free trial period. If you let your free trial lapse, you must reactivate your site with Squarespace. I will not issue you a new website template if your trial expires.

LICENSE

Each purchase grants you a limited, non-exclusive, non-transferable, single-seat license to the template. If you need to install the template more than once, multiple templates must be purchased.

→ In short — 1 template purchase = 1 website only.

My templates come with a one-time use license, each Squarespace template can be used for one website only. If you want to use the template for a different person/business/website, you must purchase another license (simply purchasing the template again).

By accessing or using my templates, you agree to abide by these terms:

  1. You may not share, resell, duplicate, or exploit the template in whole or in part.

  2. You may not use, adapt, or represent my templates or designs as if they were created by you.

  3. You may not create any derivative work and offer competing offerings based on information contained in your purchase.

  4. The design is copyrighted Hey Dani Creative and I own the rights to all design and files, included in your purchase and design.

  5. Your completed website design may be used in my template showcase, sales page, or on my social media for demo and promotion purposes.

  6. You may not violate my intellectual property rights, including copyright and trademark, as specified above.

You understand that engaging in unauthorized use of my templates is considered theft, and I reserve the right to prosecute it as a civil and/or criminal offense.

Hey Dani Creative Templates owns the copyright to the design and all files included with your template (excluding photos).

→ You may not share the template design or any design materials provided within your purchase with anyone else. Templates (and any materials/files provided with your purchase) cannot be resold, shared, duplicated, or claimed as your own in any way.

→ If you are buying a Squarespace template for a design client, you cannot claim the template as your own original work.

→ Photos used in the templates are for demonstration purposes. Although, they are free to use, compliments of Pexels.

→ Hey Dani Creative Templates reserves the right to use your completed website design in promotional material, including template showcase, for demonstration, and marketing purposes.

Each website template must retain and place our credit page (‘Site Credit’) in the website footer.

You may add your own name if you wish. as long as the hyperlink to the Hey Dani Creative Templates website is maintained.

You can use my templates for your clients, however, you must place/retain our **credit page (‘Site Credit’) in the website footer. You may not, in any circumstance, claim or promote my website template designs as your own work.

Template Access

I reserve the right to discontinue my templates and any included materials at any time in the future, for any reason. If this happens, I will give you a 15-day notice so you have time to back up the resources.

If I decide to repackage any existing resources or templates, you agree that I am not obligated to provide you that separate offering for free or at a discount.

I do my best to ensure that your experience of my templates and the Launch Suite are free of interruptions. However, due to the digital nature of my offerings, I cannot guarantee that your access will not be restricted periodically to make way for repairs, maintenance, or updates.

I will not be held liable for refunds or damages, should my offerings be rendered inaccessible to you due to network failures, server overload, backup procedures, or other similar reasons.

Requirements

Please read each template description carefully for the specific requirements of each template. All templates require a Squarespace account to be installed and the Squarespace personal subscription plan or higher. The business plan is required if you plan to take payments or utilize e-commerce and more.

Some templates require a specific Squarespace subscription tier, this will be noted in the product description.

My graphics can be edited in Canva (free plan). Depending on the template, you may need to upgrade to 'Canva PRO/Canva for work' (a paid version of Canva), however, there is a free trial available for 30 days if you don’t want to subscribe. Joining the Canva trial is simply a suggestion and I can not be held liable or responsible for any costs should you forget to cancel your free subscription before the trial end date.

Squarespace Updates

→ Since browser technology and web applications change over time, I can make no guarantee that embedded third-party applications, template designs or custom code will continue to operate in the desired way at any time after I conclude my service of template transfer. In the unlikely event that Squarespace, the third party, or web browser technology changes in such a way that this breaks your website, I can provide an estimate for fixing it at that time.

→ All of my tutorials and guides are provided as bonus content, not as part of the template. I, therefore, retain the right to not provide you with new tutorials/guides if the Squarespace platform is updated after you have purchased a template.

→ I cannot guarantee that my code plugins or templates will be compatible with any other code, plugins, customizations, or integrations that you have already or will install on your website.

→ I cannot guarantee that my plugins, coding, or templates will be compatible with any future revisions, updates or versions of Squarespace, or other third-party services.

→ Updates to Squarespace or other third-party services may render my templates, plugins, or code inoperable. Under such situations, I am under no obligation to update your templates/code plugins or inform you.

Although my templates are built with DIY in mind, I understand you may require support. Due to this, I am happy to offer 30 days of email support for any issues that are related directly with the template itself.

THIS INCLUDES:

✓ Template specific questions via email

✓ Canva graphic template questions via email

✓ Tutorial or guide clarification or questions via email

✓ Submitting a Support Ticket if there is an issue (unlimited)

THIS DOESN’T INCLUDE ISSUES RELATED TO:

  • Squarespace advice/problems

  • Additional code and modifications

  • Software problems

  • Hosting, domains and email

  • Design advice

  • Coding questions

  • IT/Computer problems

  • Re-installation or transfer

  • Out-of-date templates

By purchasing my templates, you acknowledge they are intended for DIY customization. Therefore, a general understanding of a computer, Squarespace, Canva, and the internet is required. If you feel like this is beyond your capability, please inquire about my template setup package.

Support does not include re-installation or re-transfer of any type - Once your template has been transferred, the service is considered complete.

The Squarespace platform may change or update at any time. This is out of my hands and I am not obligated to provide support for older templates built on older versions of Squarespace.

Refunds & Cancellation

My templates are digital products and due to this, I cannot offer returns, refunds or exchanges of any kind. Please review the template demos and features, faqs, template requirements, and accompanying information prior to purchasing. The template setup package is non-refundable.

I reserve the right to cancel a transfer at any time. In the event of a cancellation, I will refund the full amount of the template purchase only.

Template transfer

Your template will be built here at Hey Dani Creative HQ, I will then transfer the site to you via site permission (the Squarespace associated email address you provided during purchase) within 48 business hours. Once transferred, it is your responsibility to add your content to your template.

In order to receive the template design when choosing to have the template transferred to you as a new website, I require the email address associated with your Squarespace account. The templates are transferred prior to purchase of a Squarespace Subscription, causing more trial days.

If your website trial runs out or your site gets deleted and you want the template transferred again, you will need to re-purchase the template. Once your template has been transferred, the service is considered complete.

✓ Transferring the demo template to your provided Squarespace account as a new website

template transfer does not include:

  • Customization of any sort

  • Anything unrelated to the template

  • Revisions or refinements

  • Adding your content

  • Search Engine Optimization (SEO)

  • Squarespace tutorials

  • Social media connection

  • Migration of any kind (content, domains, blogs, etc.)

  • Domain connection

  • Integrations of any sort

Errors & Content Changes

I cannot be held responsible for any Squarespace-related errors that result in the loss of content (of any kind) or other damages during or after the template transfer.

Custom Coding

Since browser technology and web applications change over time, I can make no guarantee that embedded custom code will continue to operate in the desired way at any time after I conclude my services. In the unlikely event that Squarespace, the third party, or web browser technology changes in such a way that this breaks your website, I can provide an estimate for fixing it at that time.

I cannot guarantee that my css codes will be compatible with any other code, plugins, customizations, or integrations that you have already or will install on your website.

I cannot guarantee that my css codes will be compatible with any future revisions, updates or versions of Squarespace, or other third-party services.

Updates to Squarespace or other third-party services may render my css codes inoperable. Under such situations I am under no obligation to update your plugins or inform you.

Template setup package/service

The following is required BEFORE your project start date:

→ The questionnaire complete

→ Your logo files and any existing branding elements

→ Your font files or selections

→ Your color palette hex codes or selections

→ Finalized copy and content for entire website

→ Your high resolution images

→ Up to 3 blog posts (copy, links, images) (if applies)

→ Up to 10 products for your shop (all content) (if applies)

→ Up to 3 galleries of your images or portfolio (if applies)

The template setup do not include heavy customization - This service is for adding your content to the existing layout and template and customizing to match your brand - the template layout will remain consistent. If any of the content is left blank or not provided, those areas of your template will be left as is.

This is an add-on service that requires the purchase of a Hey Dani Creative Squarespace Template and is non-refundable. This package must be paid in full prior to start date.

*I understand each business is unique and some of these items may not apply to all.

  • Adding new pages or sections

  • Layout reworks

  • Custom Code

  • Additional page design

  • Search Engine Optimization (SEO)

  • Branding

  • Revisions

  • Anything unrelated to the Template

  • Integrations of any sort

  • Copywriting

  • Content Creation or Sourcing

  • Settings that I cannot edit and only you can include,

    • Google Workspace

    • Site Availability, you are responsible for making your site live/published

    • Permissions, or granting access to anyone

    • Billing, or managing your subscriptions and payment information

I reserve the right to cancel a template setup service at any time. In the event of a cancellation, I will refund the full amount of the template setup service only.

If the required content that’s due before our start day is not received, I will schedule a new start date with a re-engagement fee. I am not liable for client delays. I reserve the right to refuse re-engagement with the project due to lack of availability.

Anything more than what’s included that’s needed for support, I offer my time at $50/30 minutes.

Canva Templates

All Canva templates require access to Canva and basic Canva knowledge, including how to use the platform and make edits.

My Canva templates come with basic support, meaning I can help you receive and access your templates. For customization support, I offer that in my full setup package. For anything more, you'll have access to Canva customer support and their extensive tutorials.

All copy and photography is for demo purposes only and intended to be replaced.

My templates come with a one-time use license (in short, 1 template purchase = 1 project only. If you want to use the template for a different person/business, you must purchase another license/template.

Templates cannot be resold, shared, duplicated, or claimed as your own.

Due to the nature of digital products, I do not offer refunds, returns, or exchanges for any and all payments made. Please review the template details, program requirements and information before making your purchase.

Misc. Policies

All prices on the website are in United States Dollar ($USD).

You will be responsible for all costs related to your Squarespace account (including but not limited to: domains, hosting, monthly plans, annual plans, email accounts, etc).

The term "Squarespace" is a trademark of Squarespace, Inc. This website and its products are not affiliated with Squarespace, Inc.
